The purpose of this privacy policy is to inform you about the use of your personal data by Pile & Face. Please read it carefully.

1. Definitions

Capitalized terms have the same meaning as defined in the General Terms of Use.

2. Data controller

Pile & Face attaches great importance to protecting your personal data and respecting your privacy. The purpose of this privacy policy is to inform you about how we treat the personal data that you provide to us and that we collect in the course of your use of the Application and the Services. We invite you to read this document carefully to understand our practices regarding the processing of your personal data and to know your rights in this respect.

This Privacy Policy applies to all Services published by Pile & Face that you use (excluding services provided and operated by third parties, in which case the privacy policy of those third parties applies and not these provisions).

3. Information we collect

Pile & Face collects and processes personal data about you when you use the Pile & Face application or when you communicate with Pile & Face. This is information that you provide directly to us.

To ensure that our privacy policy is easy to understand, here is an overview of the personal data collected and processed by Pile & Face.

Depending on the profile you define yourself, the data collected is not the same:

Mandatory data :

For a Member without a profile who has simply logged on to the application:

  • Email (private: entered directly or retrieved via Facebook)
  • Password (private: entered directly or retrieved encrypted via Facebook)

In addition, for Members who have entered their preferences in their profile:

  • Art type preferences (public*)
  • Period preferences (public*)
  • Monument type preferences (public*)
  • Proximity distance for research (private)
  • Acceptance of Pile & Face newsletter (Y/N) (private)
  • Option to prioritize preferences in lists of cultural events (private)
  • Company search option “I’m looking for company for my visits” (Y/N) (private)

In addition, for Members who have entered their preferences in their profile AND activated the company search option to “YES”:

  • Preferred time for outings (public*)
  • Company type (public*)
  • Majority confirmation (private)
  • Nickname (public*)
  • Profession (public*)
  • City or zip code (public*)
  • Description – “About me”  free text (public*)
  • Age range (public*)
  • Gender (public*)
  • Nationality (public*)
  • Languages spoken (public*)
  • Option: “I’m a guide and offer my services” (public*)

(*) This data is only visible to other members, and therefore public, if and only if the user has activated the “company search” option in his/her Member profile.

Data required for certain purposes, non-mandatory
  • Geographical position used to prioritize events (leisure activities), parks and gardens, other members and cultural sites close to users.
  • Data relating to reports and requests sent to Pile & Face customer service.

Your description is a free text zone. Pile & Face does not encourage the Member to communicate data that may be qualified as sensitive to other Members or to Pile & Face via the Application. Sensitive data means data legally qualified as “sensitive” under the General Data Protection Regulation (“GDPR”). This includes, in particular, data relating to racial or ethnic origin, political opinions, religious or philosophical beliefs or trade union membership, as well as health, sex life or sexual orientation (“Sensitive Data”). If, despite this, the Member wishes to communicate such data on his or her profile, this communication is deemed to have been “manifestly made public” by the Member concerned, within the meaning of the GDPR.

3.1 Data you send us directly

By using our Services, you transmit information to us, some of which may identify you. When you communicate this information, some of this data is visible to other members of the Application when the member activates the company search option. This information is therefore made public on the Application.

On the other hand, other information (e-mail address, password) is not visible to other Members and is therefore not accessible to them.

Pile & Face collects and processes data relating to your registration and data relating to your interactions with Pile & Face.

3.1.1. Registration data

Mandatory information

This is the basic data required for registration in order to access the Services.

This data is collected by Pile & Face in different ways depending on the registration method you choose.

Registration data can be retrieved from Facebook, via Facebook Connect, to minimize formalism (depending on the method you choose for your registration). By clicking on the “Connect with Facebook” button, you accept that Facebook will communicate this data to us. We will only collect your email address and your profile photo, which will be used if you activate the company search option.

Alternatively, you can register via an e-mail address, in which case your details will be sent to Pile & Face directly by you. A confirmation code will be sent to the e-mail address you enter.

Depending on how you registered, this information is mandatory in order to provide the Services. If you fail to provide this information, Pile & Face will not be able to provide you with the Services offered by the Application and you will not be able to create an Account.

3.2 Data we collect automatically

When you access the Services and use the Application and its features, information is collected and processed about how you use them. The collection of this information by Pile & Face is mandatory as part of your use of the Services. Without this data Pile & Face will not be able to provide the Services related to the Pile & Face application.

This includes the date of registration, last connection, type and number of interactions with other Members.

Pile & Face may, with your express consent, access your position, approximately or more precisely depending on the technology used. Once consent has been given, you may withdraw it at any time and deactivate the geolocation option on your smartphone. In this case, lists of museums, exhibitions, monuments, leisure activities and members will no longer appear in order of proximity to your position.

At no time is a Member’s exact location or itinerary visible to other Members.

Sent and received text and voice messages (private)

Messages are sent and stored on Pile & Face servers to ensure the transmission of exchanges between Members who have had a Match. Text messages and voice messages are strictly private and commit only the Members concerned. Pile & Face’s authorized managers have no right to monitor these conversations. These messages are not transmitted or communicated to third parties, except at the request of a court and/or in accordance with applicable legal or regulatory provisions. Moreover, Messages are strictly private and will not be accessible either to other Members not involved in the exchange or to any third parties whatsoever.

Search preferences – people you want to meet

The Application allows you to configure the search for Members based on gender, guide profession or family characteristics. You can modify these parameters in the Application to be matched with profiles that meet your criteria. You will then only see cross-referenced Members who share your search preferences by selecting the appropriate option on the screen.

Mobile technical data (IP, mobile ID, application version, advertising ID, etc.)

We do not collect any information about the devices and equipment you use.

4. How do we use your data?

4.1 Provision of services and features in accordance with our terms of use

Creation and management of your Account as a Member: Creation of your profile. Registration, deregistration and deactivation of your Member profile. Management of your cultural settings and preferences.

Management and storage of communications exchanged between Members (Messages, Matches, Likes).

Sending information messages relating to the Services or your interactions with other Members (notifications).

Legal basis: Contract performance

The data collected by Pile & Face is necessary for the proper functioning of the Application under the terms of the service contract between us (General Terms of Use).

4.2 Geolocation in order to offer cross-referenced profiles

Geolocation for the purpose of proposing events (leisure activities), parks and gardens and cultural venues closest to you.

Legal basis: Consent

Once you have given your consent, you can withdraw it at any time by deactivating the geolocation option on your smartphone. Withdrawal of your consent does not affect any processing carried out prior to such withdrawal.

4.3 Propose relevant offers and content

Sending marketing messages or content:

Sending the Pile & Face newsletter by email.

Distribution of marketing content about Pile & Face on the application and by e-mail.

Marketing and advertising operations outside the Pile & Face application: we carry out marketing and advertising operations outside the Pile & Face application on third-party sites, social networks and third-party applications in order to publicize the Pile & Face application.

Legal basis: Contract performance

This processing is necessary for the performance of the contract between Pile & Face and the Member as the broadcasting of these advertisements constitutes the consideration for the use of the application.

4.4 Improving and optimizing our services and our knowledge of how you use them

Improving and optimizing Pile & Face’s services, knowledge of its Members and the way in which the Services are used: Statistical studies. Satisfaction surveys. Analysis of the use of the Application and Services by Members.

Compatible further use

This processing for statistical purposes is compatible with the following purposes: the provision of services and functionalities; the proposal of relevant offers and content; data security and the fight against illegal activities.

4.5 Ensuring the security of your personal data

To detect or prevent breaches of the security of the Services by identifying and analyzing fraudulent behavior.

Legal basis: Legitimate interest

This processing is based on Pile & Face’s legitimate interest in guaranteeing the security of its application and the data it processes. You may object to this use at any time by contacting us (see section 11. Contact). However, Pile & Face may continue to implement the processing if it can justify legitimate and compelling reasons.

4.6 Preventing and combating illegal or unauthorized activities (violation of terms of use) and complying with legal requirements

Analyze and process reports of fraudulent/undesirable behavior.

Management of undesirable behavior and warning, suspension, blocking or deletion of the Member’s Account.

Management of requests from Members to exercise their rights regarding their data.

Legal basis: Legal obligation

These processing operations are based on Pile & Face’s legal obligation, as a data host, to remove illicit content as soon as it becomes aware of it (article 6 of the law of June 21, 2004 for confidence in the digital economy) and on its obligation to respond to Members’ requests to exercise rights over their personal data (articles 12 to 22 of the GDPR).

Detect or prevent fraudulent activity:

Automated analysis of profile data, activity on the application and photos added by Members in order to detect false profiles, fraudulent behavior or behavior that contravenes the General Terms of Use.

Legal basis: Legitimate interest

This processing is based on Pile & Face’s legitimate interest in preventing and stopping fraudulent activities that may be carried out on its Services. You may object to this use at any time by contacting us (see section 11. Contact). However, Pile & Face may continue to carry out the processing if it can demonstrate compelling legitimate grounds.

5. Cookies

Cookies only concern the www.piletface.com website.

In the cache memory of the Pile & Face application, only the email address is stored as the Member’s Identifier in order to allow rapid reconnection.

5.1. Managing your cookies and mobile IDs

5.1.1. Web cookies

When you first enter the Pile & Face website (www.piletface.com), a cookie banner asks you to accept Web cookies, which are essential for the stable operation of the site.

By continuing to browse the Pile & Face website, you consent to the creation and use of all Web cookies. However, you can deactivate Web cookies at any time on your browser.

Note on pixels: Pixels generally work only in conjunction with cookies. You cannot refuse pixels, but when you refuse cookies, pixels will not be able to collect information from cookies.

WE DO NOT RECOMMEND THAT YOU BLOCK OR DEACTIVATE ALL COOKIES IN YOUR BROWSER SETTINGS. If you block all cookies, our site may not function properly and you may not be able to use some of its features.

5.1.2 Mobile identifiers

Mobile Identifiers (email) are collected and used as long as the Pile & Face Application is installed on your device.

If you do not want Pile & Face to collect and use your Mobile IDs, you should not install the Pile & Face Application on your device.

Hyperlinks:

Pile & Face contains a number of hypertext links to other sites (partners, information, etc.) set up with the authorization of the site owner. However, the owner of the site does not have the possibility of checking the contents of the sites thus visited and thus declines any responsibility as for possible risks of illicit contents.

6. How is your data shared?

Only the founders of Pile & Face process Members’ personal data for the purposes described above. These authorized managers only have access to the data they need to perform their duties.

In addition, at the request of government bodies, in particular the judicial authorities, and to comply with any legal or judicial request, Pile & Face may transmit the personal data of its Members.

7. How can you exercise your rights to your data?

Your rights

In accordance with Law No. 78-17 of January 6, 1978, known as the Data Protection Actand the GDPR, each Member has a right of access, rectification and, where applicable, a right to portability and deletion on his or her personal data, as well as opposition to processing or its limitation and the right to define directives relating to the fate of his or her personal data after his or her death. Concerned about the concerns of its Members, Pile & Face undertakes to respect the protection of personal data and to process such requests as quickly as possible.

How can I exercise my rights?

Members may exercise their rights, subject to proof of identity, by sending an email to info@evalution.fr, by exercising their rights directly from the Application, or by sending a letter to the following postal address: for the attention of the Data Protection Officer, EVALUTION 131 boulevard Carnot, 78110 Le Vésinet, France.

For all other claims, the Member may submit a request to the competent national data protection supervisory authority.

Details of rights

The right of access authorizes the Member to question Pile & Face with a view to obtaining communication of data concerning him or her in an accessible form on the basis of Article 39 of the French Data Protection Act and Article 15 of the GDPR. Your right of access must not infringe on the privacy of third parties, which is why you will only have access to your personal data and not that of third parties (for example, you will only be able to have communication of messages you have sent and not those you have received).

The right of rectification gives the Member the right to require Pile & Face to rectify, complete, update or delete personal data concerning him or her that is inaccurate, incomplete, equivocal, out of date or whose use, communication or storage is prohibited on the basis of Article 40 of the French Data Protection Act and Article 16 of the GDPR.

You can modify or rectify certain data directly from the Application. Simply go to your Profile and modify the information concerning you.

The right to portability gives the Member the right to receive the personal data they have provided to Pile & Face, in a structured, commonly used and machine-readable format and to transmit it to another data controller, on the basis of Article 20 of the GDPR.

The right to object gives the Member the right to object, free of charge and in a discretionary manner, to his or her data being used by Pile & Face for canvassing purposes, in particular commercial canvassing, and to processing based on Pile & Face’s legitimate interest, on the basis of Article 38 of the French Data Protection Act and Article 21 of the GDPR.

For processing based on legitimate interest, Pile & Face retains the possibility of justifying legitimate and compelling grounds for continuing the processing. The right to erasure confers on the Member the right to demand the erasure at no cost in a discretionary manner of data communicated to Pile & Face, within the limits of the rights based on Article 17 of the GDPR.

You can delete your Account by using the corresponding functionality directly on the Application (menu Help and Contact > Delete my profile). Please note that all your data will be deleted from the Pile & Face application. However, Pile & Face, as host, has the legal obligation to keep your personal data for one year under Article 6-II of Law No. 2004-575 of June 21, 2004 for confidence in the digital economy. Your data will be kept in an archive separate from our production databases and only for the purposes of responding to a judicial requisition. It will be definitively deleted on expiry of the one-year period.

The right to limitation gives the Member the right to request the limitation of the processing of his/her data by Pile & Face under the conditions of Article 18 of the GDPR. The Member’s right to define his or her directives concerning the retention, deletion and communication of his or her personal data after his or her death in accordance with Article 40-1 of the French Data Protection Act.

9. How long do we keep your data?

Pile & Face keeps the Member’s data for as long as is necessary for the use of the Member’s Account, i.e. :

For the duration of the Member’s registration plus one year. After one year of inactivity on an Account, it will be deleted and the Member’s data will be kept for another year, before being definitively destroyed. An account is considered inactive when the Member’s Application has not established contact with Pile & Face’s servers (notably due to the deactivation of the geolocation option); and the Member has not used the Application. It should be remembered that Pile & Face, in accordance with its status as host, is legally obliged to retain certain personal data of Members for a period of one year on the basis of article 6, II of the law for confidence in the digital economy of June 21, 2004.

When the Member deletes his/her Account or requests its deletion, it is deleted from the Application. However, the Member’s data will be kept in a separate archive for one year before being definitively destroyed, in order to enable Pile & Face to comply with its retention obligation as host. The Member’s email address will be kept for prospecting purposes for 1 year after 1 year of Account inactivity. If the Member deletes his/her Account, the email address will not be used for sending newsletters or other purposes. For requests to exercise rights: for the period enabling Pile & Face to prove that it has responded to requests in the event of litigation or control: 1 year from the month following your request.

Pile & Face undertakes to provide its best efforts and all the means in its possession to guarantee the optimal security of the data stored. Nevertheless, it is the Member’s responsibility to take appropriate measures to protect his or her data.

10. Personal data of minors

Pile & Face refuses to collect data from minors. In the event of a Member lying about his or her age group and more particularly in the event of fraudulent attestation of his or her majority, the parents of the minor child are invited to notify Pile & Face by sending an e-mail to one of the contacts indicated in article 11 “Contact”, in order to request the deletion of the data. Pile & Face undertakes to delete all personal data concerning the minor child as soon as possible.
